Evan J. Lingafelt

Associate

Evan J. Lingafelt is an associate in the firm’s Litigation Department, where he represents individuals and corporate entities in a broad range of complex civil litigation matters. His practice focuses primarily on cases involving serious injuries and fatalities, including catastrophic losses arising from motor vehicle and trucking accidents, premises liability matters, and product liability claims. He also assists home improvement companies and other businesses in pursuing amounts owed through appropriate legal remedies.

Mr. Lingafelt is frequently retained to advise and advocate for clients in complex litigation matters and commercial disputes, including breach of contract claims. He approaches each matter with careful preparation, practical judgment, and a focus on achieving results that align with his clients’ objectives.

In addition to his general litigation practice, Mr. Lingafelt represents clients in estate planning and estate litigation matters. He works closely with clients to understand their needs and prepare tailored estate plans designed to reflect their goals and protect their interests. He also represents executors, administrators, beneficiaries, and other interested parties in estate disputes, including will and trust contests, and has appeared in Orphans’ Courts throughout the Commonwealth of Pennsylvania on behalf of clients during difficult and often sensitive circumstances.

Mr. Lingafelt represents a diverse client base, including large trucking companies, family-owned businesses, and individuals. He recognizes the trust clients place in their counsel and considers it a privilege to serve as their advocate. Known for developing strategic, matter-specific approaches, he works to ensure that each litigation strategy is tailored to the client’s goals, priorities, and long-term interests. He also places a strong emphasis on responsiveness and communication, making himself available to address client questions and concerns throughout the course of representation.

Prior to joining Zimmer Kunz, Mr. Lingafelt gained practical experience in general liability, subrogation litigation, personal injury litigation, and transactional matters. He also worked with one of the largest lifting solutions businesses in North America, where he reviewed and negotiated contracts and assisted in the preparation and evaluation of stock and asset purchases. Earlier in his career, he clerked for the Honorable Jeffery A. Deller of the United States Bankruptcy Court for the Western District of Pennsylvania, where he observed and assisted with proceedings involving a variety of debtor and creditor matters.

Significant Matters

  • Barnes v. Avis Rent a Car System, LLC, et al. (Erie County, Pa. June 23, 2025), Obtained Judgment on the Pleadings to dismiss all claims and counterclaims against a rental car company under Pennsylvania’s well established Graves Amendment.  See 49 U.S.C. § 30106(a).
  • Medina v. One Stop Center, Inc. et al. (W.D. Pa. Dec. 31, 2024), Obtained Summary Judgment to dismiss Plaintiffs’ claims for punitive damages against a commercial trucking company, as well as preclude Plaintiffs’ expert from testifying at trial.
