Federal Law Update – Pregnant Workers Fairness Act Goes Into Effect on June 27, 2023

The Pregnant Workers Fairness Act (PWFA) will give workers the right to receive reasonable accommodations for limitations related to childbirth, pregnancy, or related medical conditions – unless the accommodation will cause the employer undue hardship.  Reasonable accommodations can include childbirth recovery, light duty, flexible hours, and remote work. This federal law ensures employees will not face retaliation or discrimination, and is being praised as a big advance in civil rights law that is long overdue.

The PWFA will apply to “covered employers,” which includes employers with at least 15 employees. For more information on this new law, please visit https://www.eeoc.gov/wysk/what-you-should-know-about-pregnant-workers-fairness-act.
