ZK News – Attorney Aaron Weiss Argues before PA Supreme Court
On October 17, 2023, Zimmer Kunz attorney Aaron Weiss argued before the Pennsylvania Supreme Court in the matter of Ferraro vs. Patterson-Erie Corp., No. 1 WAP 2023. This relates to a personal injury claim arising from an alleged slip and fall at a fast food restaurant on August 26, 2018. The legal issue currently pending on an interlocutory appeal pertains to lack of proper service of the complaint and whether the statute of limitations was violated. After both the Trial Court and a three judge Panel from the Superior Court ruled in favor of Plaintiff, the Supreme Court granted allocator on the following issue:
“Whether the Superior Court’s conclusion that Appellee was excused from compliance with the Rules of Civil Procedure to serve Appellant timely and via the Sheriff before the statute of limitations expired was in conflict with this Honorable Court’s holdings on the same legal question and other holdings of the intermediate appellate courts?”
The parties now await a decision.
